2. I declare, as a condition of entry into the Event, that I have undertaken sufficient training for the Event and that I am not aware of any illness, injury, physical disability or impairment which may cause me injury or death during or as a consequence of Event participation.

 

3. In consideration of acceptance of my entry in the Event, I, and on behalf of my heirs, executors and administrators, hereby release the Indemnified Parties (as defined below) from all and every claim, right or cause of action (including for negligence, breach of contract or breach of statute) I may have arising out of, in connection with, or in relation to my participation in the Event.

 

4. The above release shall operate jointly and severally in favour of F.I. and its related bodies corporate (Indemnified Parties), and their respective directors, officers, agents, contractors, employees and volunteers including medical and paramedical personnel appointed for the Event, event stakeholders, the owners, licensees and occupiers of land upon which the Event or any part of it is conducted, any statutory body or local authority having control over any land upon which the Event or any part of it is conducted, Event sponsors, supporters, persons, corporations, contractors, sub-contractors, volunteers and employees involved or otherwise engaged in promoting, staging, administering, running or controlling the Event. 

 

5. I agree to indemnify and keep indemnified the Indemnified Parties against all actions, suits, demands, claims, proceedings, costs, expenses, liabilities and judgements whatsoever (including without limitation for negligence, breach of contract and/or breach of statute) arising out of, in connection with, or in relation to my participation in the Event. This indemnity may be pleaded as a bar to any action, claim, demand, suit or legal proceedings. The releases and indemnities in this document continue forever and bind my heirs, executors, personal representatives and assigns.

 

6. Only online sign up will be accepted. The information on how to enter and the details about the Event forms part of these terms and conditions of entry. The number of participants will be strictly limited and will be decided on the basis of first received or until registrations close. 

 

7. I agree to accept full responsibility to inform myself and assess all the dangers, hazards and risks of entry in the Event and rely solely on my own assessment of these dangers, hazards and risks before participating in the Event and notwithstanding any decision thereon made by persons, corporations and bodies involved in promoting or staging the Event. The decision to participate is entirely my own and I accept all risks associated with participation in the Event, including but not limited to loss of life and/or any injury including without limitation any permanent injury.

 

8. I agree to abide by all Event terms and conditions. I understand that I must obey all directions and instructions given by Event officials.

 

9. I agree and accept that F.I. may, in its absolute discretion, at any time and from time to time vary the rules, regulations and terms & conditions of the Event and without prior notice to me.

 

10. I consent to receive such medical aid or preventative treatment which may be deemed advisable in the unfettered discretion of Event Medical Officials in the event of any injury accident or illness to me during my participation in the Event.

 

11. F.I. reserves the right, in its discretion, to reject or cancel my entry at any time, including without limitation for safety or insurance reasons. F.I. will not be obliged to refund any portion of the entry fee in such circumstances.

 

12. F.I. reserves the right to change or modify any part of the Event including the date.

 

13. Prior to commencing the class, participants are required to inform event staff of any issues or relevant physical issues. 

 

14. I acknowledge that I will not be entitled to any refund if the Event is cancelled for any reason. 

 

15. I consent to the publication and/or use in any form of media whatsoever of my name, image, voice, statement or otherwise, (including the publication of my name, suburb and applicable age bracket in any F.I. publication, media and/or on the Event website) without payment or compensation.  

 

16. If you are under the age of 16 and have registered for an Event, you expressly advise that you have been granted permission from your parent or legal guardian and they will be required to attend the Event with you in person. We have the right to refuse a minor access to the Event in circumstances where the parent or legal guardian does not attend the Event with the minor. Please note the parent and/or legal guardian does not need to register a ticket for himself or herself in addition to the minor if they do not wish to participate. The parent/legal guardian is able to attend the Event at no charge to watch and accompany the minor.

 

17. In consideration of the Event agreeing at my request to accept the entry of a minor, I agree for myself, the Participant, their heirs, executors and administrators to indemnify and keep indemnified the Indemnified Parties against all actions, suits, claims, proceedings, demands, cost, expenses, liabilities or judgements which the Participant and/or I may have against the Indemnified Parties but for the terms of this agreement in respect of any death, injury, damage or loss sustained by the Participant as the result of the Participant’s participation in the Event. I affirm that I have full authority on behalf of all living parents and/or guardians to grant this Indemnity and that this indemnity may be pleaded as a bar to any action claim demand suit or legal proceedings. 

 

18. F.I. reserves the right to cancel the Event at any time if F.I. considers in its sole discretion this is required due to any sort of dangerous conditions and/or force majeure. In the event of cancellation, there will be no refund of sign up fee and the cancelled Event may not necessarily be re-scheduled. A decision will be made ASAP on the day of the activity and announced via the Event website and social media channels. 

 

19. All online sign up fees will be donated to the Sally Fitzgibbons Foundation and will incur gst. 

Privacy Collection Statement:

 

F.I. collects your personal information for the administration of the Event and for future marketing and promotional purposes relating to F.I. Events and/or the F.I. group of companies. F.I. may disclose your personal information to its related bodies corporate and any third parties involved in the Event, including service providers. I acknowledge that information collated on the entry form submitted by me and relating to me may be shared with the Fitzgibbons International database managers and other organisers of the Event. I understand that my personal information is being collected by F.I. in compliance with the regulations set out in the Privacy Act 1988, as amended (“Privacy Act”), and the Australian Privacy Principles for the purpose of conducting and facilitating my participation in the Event. I understand that if I choose not to share certain personal information that my application may be rejected in F.I.’s discretion.  I understand that if I wish, I am able to access, change and update information F.I. has about me at any time by contacting F.I., subject to the terms of the Privacy Act. I understand that F.I. will endeavor to respond to my request within 30 days, that F.I. may be contacted during normal working hours on (02) 9949 7959 and that F.I. is happy to send to me a full copy of the Privacy Policy should I require more information. I acknowledge that the Privacy Policy also contains information about how I may complain about how my personal information is handled, used and disclosed. I agree to the sharing of my personal information with F.I. and its insurers in relation to any incident or personal illness that has reasonable and direct relation to the Event. Personal information will be treated in accordance with the preference I indicate in the ‘privacy statement’ section of the entry process.
