TERMS AND CONDITIONS OF SALE AND ENTRY

Paradise Music Festival (Event) is presented by Paradise Pty Ltd (Paradise, Us, Our, We, the Presenter) (ABN: 58600733275). By purchasing a ticket to Paradise, you acknowledge and agree to these Terms and Conditions of Sale and Entry.

Tickets

Be aware, ‘Ticket’ and ‘Wristband’ are interchangeable terms used for a Paradise ticket. Festival wristbands must be worn at all times around the wrist of the festival wristband holder when at the Paradise site. Your wristband gains you entry in and out of the Festival site whilst gates are open. Any person not wearing an official event wristband will be evicted from the event. Tickets will be sent electronically to the nominated email address proved during the checkout process. You must printout your ticket and bring it with you for validation at the gate prior to entry. You will be issued your festival wristband upon entry

Emergencies

In the case of an emergency evacuation or situation, you must follow all official directives. You may not be able to take personal items with you. In such circumstances Paradise does not take responsibility for, nor will it replace or refund the cost of, or the items themselves.

Refund policy

Tickets are sold on a no refund or exchange basis. In the instance of event cancellation, you will be not be refunded. In the event of a change to the event time and/or venue, your ticket will be made valid to a rescheduled show. In both instances please check www.paradisemusic.com.au or contact [email protected] for further information. The right is reserved to vary advertised programs and to add, withdraw or substitute artists where necessary. There will be no refunds for line-up changes. Paradise reserves the right to refuse admission and in such an event will not refund any admission fee paid. Your tickets should be treated as cash. Save as required by law, tickets will not be replaced nor money refunded after purchase. Paradise does not offer refund in the event of lost, stolen or damaged tickets or where the ticket holder cannot attend the event due to reasons beyond Paradise’s control.

Resale policy

Tickets may not, without the prior consent of the Presenter, be resold or offered for resale at a premium over the face value of the ticket (including via online auction sites) or used for advertising, promoting or other commercial purposes (including competitions and trade promotions) or to enhance the demand for other goods or services either by the original purchaser from the Presenter or any subsequent ticket holder.

Entry

When entering the festival premises your ticket information will be checked against your Photo ID, and any inaccuracies that prevent us from identifying you as the owner of the ticket may prevent you from being allowed access to the event. You must be +18 to enter. The Presenter reserves the right to refuse a ticket holder admission to the event or to evict that person from the event. Entry is at the attending person’s own risk. Without limiting the generality of this, appropriate footwear and clothing must be worn at all times on the site and ear plugs should be worn when necessary. Paradise takes no responsibility for any hearing damage or loss caused by excessive noise. Noise reducing ear plugs will be available free of charge to any person on site and can be collected from the Information Desk. It may be a condition of entry to the property that a search of your person and/or your possessions and motor vehicles is required at the time of entry or throughout the Event. Glass, weapons, illegal substances or any item Paradise considers may be used in an illegal or offensive may be confiscated. Refusal to consent to a search will prevent entry to the Event or eviction, without refund. Patrons are not permitted in VIP or backstage or media areas. Strobe lighting and flashing lights will be present at some performances. Those attending acknowledge that entering the Event has inherent dangers and risks including a risk of serious injury or even death. In the event of injury or illness Paradise may, at the cost of the person, arrange medical treatment and/or emergency evacuation as deemed essential for their safety.

Prohibited Items

Anything that could cause harm is a prohibited item and will not be permitted entry to the venue. This includes but is not limited to bottles, glass, weapons, lasers, fireworks, pets or animals and illicit drugs. Prohibited items that are confiscated will not be returned. The event site is a glass free zone. The event is run as a total fire ban; in no case are open flames allowed.

Promotion

As this is a +18 event, entering the site you agree to being filmed and/or photographed, the product of which may be used for marketing or promotional purposes.

Conduct

You must ensure that you and your invitees act in an orderly manner when attending the Event. We may refuse entry or evict you or any of your invitees if they are behaving in an intoxicated, disorderly, offensive, threatening or inappropriate manner, towards any person. Anyone found in possession, supplying or consuming illicit drugs will be evicted from the premises and reported to Police. Crowd surfing, moshing, slam or circle dancing are all dangerous activities that can seriously injure other patrons and Paradise reserves the right to evict Patrons if they are involved in such activities.

Liability

Entry to the Event is at your own risk. To the fullest extent permitted by law, we do not accept liability of any nature for the acts, omissions or default of those providing services in connection with the Event or any liability for any injury, damage, loss, delay or additional expenses which are incurred at or in association with this Event. Where legislation implies any condition or warranty which cannot be excluded or modified, that condition or warranty will be deemed to be included in this agreement. However, our liability for any breach of such condition or warranty will be limited, at our option, to the resupply of the services or the cost of having the services supplied again. In no event will we be liable for any indirect, consequential, exemplary or special damages. To the full extent permitted by law, ticket holders waive all legal rights of action against and fully release Paradise, its agents, employees, members and volunteers for all claims for compensation for loss, damage, injury or death howsoever arising out of or in relation to the ticket holder’s participation in the event including without limitation, liability for any negligent or tortious act or omission on the part of the persons released or under statute or for breach of these terms and conditions. Paradise shall not be held liable for any loss, injury or damages sustained entering or at the event.

Safety on site

Paradise takes the safety of patrons and the safety of others on site very seriously. Whilst in attendance at the Event you are required to follow all site safety requirements. There is no exception to this requirement except when directed by emergency services. Whilst at the Event appropriate signage will be in place setting out site safety requirements. You must read these signs when on site. If you do not understand any of the site safety requirements on these signs please see an appropriate person on site for clarification. By purchasing your ticket you agree to be bound to the Event site safety rules and requirements.

Lake Mountain Resort / Parks Victoria Terms and Conditions

Paradise is held on Lake Mountain Resort and parts of the festival are located within Yarra Ranges National Park. By purchasing a ticket to Paradise, you acknowledge and agree to Lake Mountain Resort and Parks Victoria Terms and Conditions. These can be found at http://lakemountainresort.com.au/ andhttp://parkweb.vic.gov.au respectively.

Any breach of any of these terms and conditions will entitle the event organisers to evict the attending person from the private property.
