Host and Attendees Responsibilities:
Conditions of Entry: for Pacific Promotions (‘PP’) Pty Ltd Events:
PP reserves the right to refuse entry/registration and to exclude any objectionable or intoxicated persons from the event/premises without liability.
PP reserves the right to refuse entry/registration from people deemed to be competitors or if an objection is raised by an event partner.
PP retains the right to require any person to leave the venue or Event if that person:
(a) Engages in conduct which unreasonably interferes with other persons wishing to enjoy the Event;
(b) Hampers or impedes the provision of hospitality by PP to other clients and/or the conduct of the Event;Â
(c) Breaches any laws, by-laws, orders or other rules applicable to the venue or the Event; or is not observing their obligations hereunder.
Be responsible for the reasonable dress standard and the good behaviour of all persons attending the Event as your guests or invitees.
Exercise host responsibility in respect of the amount of alcohol consumed; age of invitees and in the dangers of drinking and driving.
Use the facilities provided by PP as part of the hospitality packages, and any property of PP (or its licensors, contractors, assigns, partners or successors) for the purpose intended, and indemnify PP in respect of any damage caused by you or your invitees' wilful, negligent, or inadvertent act.
Not bring any cameras, food or alcoholic beverages to the Event and further agree that alcoholic beverages may be consumed only as directed by PP, the principals, officers or administration of the venue.
Comply with the non-smoking restrictions at the venue.
Comply with the requirements of the venue owners, any competent local or statutory authority or with the laws or other rules and regulations of any other relevant authority.
If a person fails to leave the venue after being requested to do so then your licence to remain at the venue shall automatically be revoked.Â
Cancellation Policy / DisclaimerÂ
There are no exchanges or refunds except as required by law. If you are unable to attend, you can provide a substitute. If a refund is made, PP may retain an administration fee. PP reserves the right to add, withdraw, reschedule or substitute speakers and/or vary advertised programmes.
PrivacyÂ
The information supplied on registration or via the pledge draw, business card draw, auction or other method by any of your guests or attendees will be shared and used by PP and sponsors of the event. Unless you advise PP otherwise, your name and contact details will be included in the list of event participants distributed to sponsors of the event. By registering for this event you are automatically subscribed to our database. If you wish to be removed from these databases please let us know in writing and we'll have you removed immediately. You are also welcome toÂ
unsubscribe at any time in the future by notifying PP or our sponsors from whom you receive communications.Â
Payment by InvoiceÂ
Where payment is not made by the due date, PP reserves the right to charge additional default interest of 5% above the base-lending rate charged by Westpac. The charging of interest does not imply the granting of any extension of any credit terms. The customer shall pay any expenses, disbursements and legal costs incurred by PP in the collection of outstanding monies.Â
Personal Guarantee
Where the Customer is a Limited Liability Company PP regards the directors/shareholders personally liable for payment of all PP's fees/disbursements and that in the event of the Debtor Company being in default of its obligations under this agreement to PP, PP shall be entitled to sue those directors/shareholders personally for recovery of those monies.
General Terms and Conditions
THE FOLLOWING TERMS AND CONDITIONS SHALL APPLY TO ALL TICKETHOLDERS:
1.0 Booking ProcedureÂ
1.1 following a request being made by a purchaser of tickets ("you", "your", or "Client") to PP or its agent ("Seller"), booking confirmation will be issued by email. Execution of the booking shall be deemed to be acceptance by the Client of these terms and conditions. Upon receipt of the booking in writing the Seller will send the Client confirmation and corresponding invoice(s) which are payable within 48 hours.Â
2.0 Refunds Due to Event Cancellation
2.1 upon receipt of the ticket payment, the Seller will deduct an administration charge of 15% and a bank charge of 2%. These amounts are non-refundable. The balance of the payment will be refunded by PP upon the Event being cancelled.Â
3.0 Your Obligations
3.1 You agree to (as applicable):
(a) Pay all monies due and owing when specified;
(b) Pay interest at 18% per annum calculated on a daily basis on all sums unpaid from the due date for payment until payment is received by the Seller;Â
(c) Pay to PP any costs incurred by PP in recovering sums owed hereunder or damages for non-performance hereof including legal costs on a full indemnity basis;
(d) Be responsible for the reasonable dress standard and the good behaviour of all persons attending the Event as your guests or invitees;
(e) Exercise host responsibility in respect of the amount of alcohol consumed, age of invitees and in the dangers of drinking and driving;Â
(f) Use the facilities provided by PP as part of the Packages, and any property of PP (or its licensors, contractors, assigns, partners or successors) for the purpose intended, and indemnify PP in respect of any damage caused by you or your invitees' wilful, negligent, or inadvertent act;
(g) Not bring any cameras, food or alcoholic beverages to the Event and further agree that alcoholic beverages may be consumed only as directed by PP, the principals, officers or administration of the venue;Â
(h) Comply with the non-smoking restrictions at the venue;Â
(i) Comply with the requirements of the venue owners, any competent local or statutory authority or with the laws or other rules and regulations of any other relevant authority.Â
4.0 Enjoyment of Others
4.1 PP retains the right to require any person to leave the venue or Event if that person:Â
(a) Engages in conduct which unreasonably interferes with other persons wishing to enjoy the Event;
(b) Hampers or impedes the provision of hospitality by PP to other clients and/or the conduct of the Event;
(c) Breaches any laws, by-laws, orders or other rules applicable to the venue or the Event; or
(d) Is not observing their obligations hereunder.Â
4.2 If a person fails to leave the venue after being requested to do so then your licence to remain at the venue shall automatically be revoked.Â
5.0 PP's ResponsibilitiesÂ
5.1 PP shall organise and provide the tickets as detailed in the booking and in doing so will use all reasonable care and skill. PP is not responsible for the supply of food and beverage.Â
5.2 PP reserves its right to substitute the form of hospitality offered for similar products of a similar standard. Notice will be provided where possible, but PP is not obliged to do so.
5.3 Except to the extent that PP's liability may not be excluded by law:
(a) PP will not be liable for any loss or damages arising, including but not limited to loss of income, profits, interest, opportunity or loss of market, and whether such losses may be direct, or special, or indirect or consequential, and whether or not PP had knowledge that such damages may be incurred; and
(b) PP shall not be liable in respect of goods or services that it does not supply in providing the Hospitality or which are additional to the hospitality described in the booking.
6.0 PRICE
6.1 GST (or any other applicable tax) at the rate of 15% (or as may be varied by law) shall be payable in addition to the price.Â
7.0 CancellationÂ
7.1 There are no exchanges or refunds except as required by law and in accordance with clause 2.1 above. If you are unable to attend, you can provide a substitute. PP Events reserves the right to add, withdraw, reschedule or substitute fighters/entertainment and/or vary advertised programmes or venues.Â
7.2 Without limiting any other provision hereof, PP has no liability to make any refund to you except in the circumstances set out in clause 2.1 above. PP recommends that you consider obtaining appropriate insurance cover through your own insurance broker. Should a facility or venue for the Event for any reason be destroyed or made unusable PP is not obliged to make any refund.
7.3 Subject to Australian Consumer Law, tickets cannot be exchanged or returned after purchase and liability is limited to refunding the price minus the administration charge of 15%, and the bank charge of 2% where the event or performance is cancelled and not rescheduled. A time limit may apply to refunds.
7.4 If you are in the business of or hold yourself out as acquiring goods/services from PP for the purposes of a business, you as a buyer acknowledge that you are not entitled to claim any of the remedies provided under the Australian Consumer Law from PP and that the provisions of that Law do not apply to you.
7.5 Tickets or vouchers will be void if on sold, traded, scalped or used as a competition prize or for promotional purposes without written authority from PP.Â
7.6 The Event may be rescheduled in whole or part to the day after the scheduled event date if necessary, at a time determined by the PP due to adverse weather or other adverse conditions as deemed by PP. Any such rescheduling will be notified. In this case, your ticket will be valid for the rescheduled date and you will not be entitled to a refund.
7.7 The terms and conditions shall be read subject to the provisions of the Major Events Act 2014 at all times.Â
8.0 Disclaimers and IndemnityÂ
8.1 You hereby waive and release PP from and indemnify and hold PP harmless against, any and all costs, damages and expenses, which are incurred by you, your agents, employees, invitees and/or guests and which arise in connection with the Event.Â
8.2 These terms and conditions constitute the sole and exclusive agreement between us. You acknowledge that no other warranties, representations, written or verbal, have been made that are not reflected herein.
8.3 To the extent limited by law PP's absolute liability, whether for breach of these terms or in negligence or in any other tort or for any other common law or statutory cause of action arising in relation to these terms and conditions, or the ticket purchase is limited to the price paid for the tickets. To any extent limited by law PP will not be liable for any direct, incidental, consequential or indirect damages, loss, loss of profits, goodwill bargain, or opportunity or loss of anticipated savings resulting from your purchase of tickets, whether based on warranty, contract, tort, negligence or any other legal theory, or whether or not we know the possibility of such damage.
8.4 PP may vary these Terms and Conditions at any time. Any variations become effective on posting on its website: www.pacificpromotions.com.au by making a purchase after the terms and conditions have been varied; you agree to be bound by the variation.
8.5 PP reserves the right to change the line up of the Event incl. date, venue, fighters and entertainmentÂ
9.0 Force Majeure
9.1 PP may cancel, interrupt or stop the Event due to circumstances beyond its control and  PP reserves the right to alter the advertised fights or card without notice.
9.2 PP is not liable for failure to deliver or provide the Event or for any delay in delivery or in providing the Event where such failure or delay is caused by strike, combination of workmen, lockout, difficulty in procuring components or materials, shortage of labour, lack of skilled labour, delays in transit, failure or delay by you in performing any of your obligations hereunder, failure or delays by suppliers or subcontractors, failure, bad weather, delay or inability to obtain any necessary authorisation, legislative, departmental or other prohibition or restrictions, fire, flood, hostilities, commotions or other causes whatsoever (whether similar in nature or not to the foregoing) beyond PP's reasonable control.Â
10.0 Privacy
10.1 the information supplied on the registration form will be shared and used by the Organising Committee. Unless you advise the Organisers otherwise, your name and contact details will be included in the list of event participants distributed to sponsors of the event. By registering for this event you are automatically subscribed to our database. You will be given the opportunity to opt out of future email communications from us after the post event survey has been concluded.
11.0 Governing LawÂ
11.1 These Terms and Conditions shall be governed by the laws of Queensland Australia and the parties hereby irrevocably submit to the exclusive jurisdiction of the High Court at Queensland, or any court, which may hear appeals from that court.
12.0 Personal Guarantee
12.1 Where the Customer is a Limited Liability Company PP regards the directors/shareholders personally liable for payment of all PP's fees/disbursements and that in the event of the Debtor Company being in default of its obligations under this agreement to PP, PP shall be entitled to sue those directors/shareholders personally for recovery of those monies.
Entry to the event is deemed to be final acceptance of all terms and conditions.
Ticketbooth Pty Ltd, ticketbooth.com.au (collectively "Ticketbooth") operate the ticketbooth booking system and web pages ("ticketbooth platform") for events created by EVENT ORGANISERS. Â Ticketbooth provides the Ticketbooth platform and associated software to EVENT ORGANISERS so that they may list event details, set ticket inventory, sell tickets, take registrations and manage other event functions using the Ticketbooth platform. Ticketbooth provides access to certain parts of the ticketbooth platform to the general public so that they may transact and interact with the EVENT ORGANISER. Â
The following Terms and Conditions of Use and Purchase Policy ("these Terms") have been created to ensure you are happy with your ticket purchase and that you fully understand the purchase process with the EVENT ORGANISER who uses Ticketbooth, the Ticketbooth platform, Ticketbooth powered partner websites and Ticketbooth retail store associates to promote the EVENT ORGANISER's events, sell tickets, make registrations and bookings.
Illegal and/or unauthorised uses of the Ticketbooth platform, whether for unauthorised ticket sales, unauthorised framing of or linking to the ticketbooth platform will be investigated and appropriate legal action will be taken.
You may only submit content to the ticketbooth platform ("User Content") where you have the rights to do so. In particular, you:
Ticketbooth processes your credit card depending upon the methods accepted by the EVENT ORGANISER which may include: Visa, MasterCard, American Express and Paypal checkout.
When purchasing tickets on ticketbooth, you are limited to a maximum of 10 tickets for each event unless the EVENT ORGANISER has authorised such purchases in its terms and conditions. If you try to circumvent the ticketbooth platforms to purchase more than 10 tickets the EVENT ORGANISER may at its discretion cancel additional bookings. This limitation has been designed to prevent unfair buying practices at popular events and make sure everyone gets a fair chance of attending the event. The reselling of tickets is strictly prohibited by non-authorised re-sellers, tickets found to be re-sold maybe voided and canceled at Ticketbooth's discretion.
In Australia, Ticketbooth sometimes sells tickets for events at licensed venues, and these venues require a valid driver's license, passport or proof of age to prove you are over 18 years of age. You may need to present this proof at the event venue to obtain admission. The venue or door staff reserve the right to refuse any patron entry at their discretion if invalid ID is provided.
Through the ticketbooth platform the EVENT ORGANISER may elect to offer one or more of the following delivery options for your ticket order. The proof of identity requirements set out in clauses 12 and 13 will apply regardless of the delivery of ticket method used.
Before purchasing tickets, carefully review your event and ticket selection. Policies set forth by EVENT ORGANISER will dictate the issuing of exchanges or refunds after a ticket has been purchased or for lost, stolen, damaged or destroyed tickets.
Ticket purchases once made through Ticketbooth are final unless approved by the EVENT ORGANISER prior to the event date. Â Exchanges and partial refunds must be set forth to the EVENT ORGANISER for review and approval at their discretion prior to actioning by Ticketbooth.Â

EVENT ORGANISERS may also append the ticketbooth terms and conditions and these additional terms are displayed and agreed to by the purchaser during the booking process.
