Ticketbooth Terms and Conditions of Sale

Ticketbooth Pty Ltd, Ticketbooth.com.au (collectively "Ticketbooth") operate the Ticketbooth booking system and web pages ("Ticketbooth platform") for events created by Oktoberfest Brisbane. Ticketbooth provides the Ticketbooth platform and associated software to EVENT ORGANISERS so that they may list event details, set ticket inventory, sell tickets, take registrations and manage other event functions using the Ticketbooth platform. Ticketbooth provides access to certain parts of the Ticketbooth platform to the general public so that they may transact and interact with Oktoberfest Brisbane.

The following Terms and Conditions of Use and Purchase Policy ("these Terms") have been created to ensure you are happy with your ticket purchase and that you fully understand the purchase process with Oktoberfest Brisbane who uses Ticketbooth, the Ticketbooth platform, Ticketbooth powered partner websites and Ticketbooth retail store associates to promote Oktoberfest Brisbane's events, sell tickets, make registrations and bookings.

Section 1 - General Terms

You must be 18 years to use this service with a credit card. By using or visiting the Ticketbooth platform, you expressly agree to be bound by these terms and to follow these terms and all applicable laws and regulations governing the Ticketbooth platform.

Ticketbooth Pty Ltd and Ticketbooth.com.au (collectively "Ticketbooth") reserve the right to change these terms at any time, effective immediately upon posting on the Ticketbooth platform. To ensure you are aware of the latest Purchase Policy and Terms and Conditions of Use, please check this page of the Ticketbooth platform periodically which is available from every event page on the Ticketbooth platform. The latest date of issue will be posted at the top of this page.

Section 2 - Permitted Use Of The Ticketbooth Platform

You agree that you are only authorised to visit, view and to retain a copy of pages of Ticketbooth platform for your own personal use, and that you shall not duplicate, download, publish, modify or otherwise distribute the material on this site for any purpose other than to review an event and its promotional information, for personal use, or to purchase tickets for your personal use, unless otherwise specifically authorised by Ticketbooth to do so.

The content and software on this site is the property of Ticketbooth and is protected by Australian and international copyright laws. We post a legal notice and various credits on the Ticketbooth platform, which may not be amended or removed. You must not remove this notice or these credits, or any additional information contained along with the notices and credits.

Section 3 - Links And Search Results On The Ticketbooth Platform

The Ticketbooth platform may include links posted by Oktoberfest Brisbane or automatically produce search results that reference or link to third party sites throughout the World Wide Web. To the extent permitted by law, where Ticketbooth has no control over these web sites or the content contained within them, Ticketbooth cannot guarantee, represent or warrant that the content contained in third-party websites is accurate, legal and/or inoffensive.

Ticketbooth does not endorse the content of any third party site, nor do we warrant that they will not contain viruses or otherwise impact your computer in a harmful or damaging way. By using the Ticketbooth platform to search for or link to another site, you agree and understand that you may not make any claim against Ticketbooth for any damages or losses, whatsoever, resulting from your use of the Ticketbooth platform to obtain search results or to link to another site. If you have a problem with a link from the Ticketbooth platform, please notify us at [email protected] and we will investigate the problem you describe in your email and take actions that we deem are appropriate in our sole discretion.

Section 4 - Unauthorised Use Of The Ticketbooth Platform

Illegal and/or unauthorised uses of the Ticketbooth platform, whether for unauthorised ticket sales, unauthorised framing of or linking to the Ticketbooth platform will be investigated and appropriate legal action will be taken.

Section 5 - Violation Of These Terms And Conditions

If you violate these terms including if you post or provide User Content which violates these terms or has violated the rights of Ticketbooth, any other User or the law, Ticketbooth may terminate your use of the Ticketbooth platform, prevent you from making all future bookings using the Ticketbooth platform, and/or take legal action against you. Where this occurs, Ticketbooth will provide you with reasonable prior written notice that this will be implemented, together with reasons for that action being taken. If you wish to dispute that decision of Ticketbooth, you have 5 days within Ticketbooth providing its notice to you to do so and Ticketbooth will act reasonably in considering your response.

If you materially violate these terms (which includes any breach of clause 6), in addition to paragraph 5(a), Ticketbooth may cancel your ticket orders in which case Ticketbooth will provide you with written notice of that cancellation together with reasons for that cancellation and will provide you with a refund of the ticket price paid by you.

You agree that monetary damages may not provide a sufficient remedy to Ticketbooth for violations of these terms and conditions and you consent to injunctive or other equitable relief for such violations.

Ticketbooth may release user information about you if required by law or subpoena, or if the information is necessary or appropriate to release to address an unlawful or harmful activity. This is in addition to any other uses permitted under our Privacy Policy.

Ticketbooth is not required to provide any refund to you if you are terminated as a user because you have violated these Terms, except as expressly set out in these terms.

Section 6 - Ticketbooth Copyright Policy

You may only submit content to the Ticketbooth platform ("User Content") where you have the rights to do so. In particular, you:

may not use the Ticketbooth platform to unlawfully transmit copyrighted material (including articles, images, stories and software) without a license, express consent, valid defence or fair use exemption to do so; and

must ensure that the content you upload does not infringe the copyrights or other rights of third parties (such as privacy or publicity rights).

Section 7 - Disclaimers

Ticketbooth does not promise that the Ticketbooth platform will be error-free, uninterrupted, nor that it will provide specific results from use of the Ticketbooth platform or any content, search or link on it.

The Ticketbooth platform and its content are delivered on an "as-is" and "as-available" basis.

Ticketbooth cannot ensure that files you download from the Ticketbooth platform will be free of viruses or contamination or destructive features although Ticketbooth will take steps consistent with industry practice to protect against this occurring.

Ticketbooth does not by these Terms exclude any rights and remedies in respect of goods or services under the Trade Practices Act 1974 (Cth) or equivalent state or territory legislation which cannot be excluded, restricted or modified. However, Ticketbooth excludes all rights, remedies, conditions and warranties in respect of goods or services from your use of this site and the Ticketbooth platform whether based in statute, common law or otherwise to the extent permitted by law. To the fullest extent possible, the following paragraphs of this clause 7 will apply.

Ticketbooth will not be liable for any damages of any kind arising from the use of the Ticketbooth platform, including without limitation, direct, indirect, incidental, and punitive and consequential damages.

Ticketbooth makes no guarantee of any specific result from use of the Ticketbooth platform or use of the Ticketbooth service.

Ticketbooth disclaims any and all liability for the acts, omissions and conduct of any third party users, Ticketbooth users, advertisers and/or sponsors on the Ticketbooth platform, in connection with the Ticketbooth service or otherwise related to your use of the Ticketbooth platform and/or the Ticketbooth service. Ticketbooth is not responsible for the products, services, actions or failure to act of any venue, performer, promoter or other third party in connection with or referenced on the Ticketbooth platform.

Without limiting the other provisions of this clause 7, you may report the misconduct of users and/or third party advertisers, service and/or product providers referenced on or included in the Ticketbooth platform to Ticketbooth at [email protected]. Ticketbooth may investigate the claim and take appropriate action, in its sole discretion.

Section 8 - Payment Methods

Ticketbooth processes your credit card depending upon the methods accepted by Oktoberfest Brisbane which may include: Visa, MasterCard, American Express and Paypal checkout.

Section 9 - Limits On Tickets Purchases Per Customer

When purchasing tickets on Ticketbooth, you are limited to a maximum of 10 tickets for each event unless Oktoberfest Brisbane has authorised such purchases in its terms and conditions. If you try to circumvent the Ticketbooth platforms to purchase more than 10 tickets, Oktoberfest Brisbane may at its discretion cancel additional bookings. This limitation has been designed to prevent unfair buying practices at popular events and make sure everyone gets a fair chance of attending the event. The reselling of tickets is strictly prohibited by non-authorised re-sellers, tickets found to be re-sold maybe voided and cancelled at Ticketbooth's discretion.

Section 10 - Pricing And Ticket Availability

Ticketbooth sells tickets on behalf of Oktoberfest Brisbane which means Ticketbooth does not determine the ticket prices, booking fees, postage and handling fees (if posted tickets are an option) or the seating selections.

Ticket inventory is the responsibility of the Oktoberfest Brisbane. Given inventory set by Oktoberfest Brisbane, popular events may sell out quickly. Occasionally, additional tickets may be available in addition to inventory using Ticketbooth set by Oktoberfest Brisbane, however Oktoberfest Brisbane controls this inventory and its availability at their own discretion.

Section 11 - Credit Card Purchases - Proof Of Identity

In most cases where you purchase your tickets using a credit card, in order to collect your tickets, you will be required to present the credit card used to purchase tickets and a picture identification, which must match each other and must match the name under which the booking was made.

Section 12 - Licensed Venues - Proof Of Identity

In Australia, Ticketbooth sometimes sells tickets for events at licensed venues, and these venues require a valid driver's license, passport or proof of age to prove you are over 18 years of age. You may need to present this proof at the event venue to obtain admission. The venue or door staff reserve the right to refuse any patron entry at their discretion if invalid ID is provided.

Section 13 - Delivery Of Tickets

Through the Ticketbooth platform, Oktoberfest Brisbane may elect to offer one or more of the following delivery options for your ticket order. The proof of identity requirements set out in clauses 12 and 13 will apply regardless of the delivery of ticket method used.

Section 14 - Cancelled Events

Occasionally, events are cancelled or postponed by Oktoberfest Brisbane due to weather conditions or situations affecting the staff or audience. When this occurs, Oktoberfest Brisbane will make every effort to ensure you receive a prompt refund and/or exchange if applicable.

Section 15 - Exchanges And Refunds

Before purchasing tickets, carefully review your event and ticket selection. Policies set forth by EVENT ORGANISER will dictate the issuing of exchanges or refunds after a ticket has been purchased or for lost, stolen, damaged or destroyed tickets.

Ticket purchases once made through Ticketbooth are final unless approved by Oktoberfest Brisbane prior to the event date. Exchanges and partial refunds must be set forth to Oktoberfest Brisbane for review and approval at their discretion prior to actioning by Ticketbooth.

Section 16 - Other Items

EVENT ORGANISERS may reserve the right of:

1. Admission to events, latecomers may not be admitted until a suitable break.

2.To change/withdraw advertised artists, programs or seating without notice.

EVENT ORGANISERS may also append the Ticketbooth terms and conditions and these additional terms are displayed and agreed to by the purchaser during the booking process.

Oktoberfest Brisbane is a German Cultural Festival which exists to share our culture, heritage and passions with you. The festive atmosphere encourages the appreciation and responsible enjoyment of what our culture has to offer. Anyone expecting a 'swillathon' will only be disappointed.

As a festival organiser, we take our responsibility to create a safe and enjoyable experience for everyone seriously. Anti-social behaviour will not be accepted. To ensure we succeed at presenting the quality festival you have come to expect, we have written these terms and conditions.

First up, 'you' and 'your' refers to the customer. 'We', 'us', 'our', 'Oktoberfest' and 'festival organiser' refers to Oktoberfest Brisbane Pty Ltd, its employees, contractors, volunteers and authorised persons. 'This agreement' means these terms & conditions and any other conditions specified by us on our website, booking forms or other communications.

Safety is paramount. Whilst at the festival, your safety and the safety of those around you is our primary focus and essential to your enjoyment of the festivities. So please enjoy a meal together, drink water regularly, protect yourself from the sun and consume alcohol responsibly.

We engage qualified first aid staff who are there to help with any medical situation. By attending the festival, you consent to these qualified first aid providers accessing medical information about you available to them and treating you accordingly.

Oktoberfest Brisbane Staff love you very much, so anything they ask you to do is because they want you to have an awesome day. Please listen and follow any reasonable directions they might give you, it could be important!

Proof of Age ist sehr wichtig {is very important}! Oktoberfest Brisbane is open to all ages and if you look younger than 25, we will ask for valid photo ID. To enter the festival site without your mum or dad, or to purchase or consume alcohol at the festival, you must have a valid photo ID as proof of age. In Queensland, the Liquor Act 1992 defines five types of ID which are acceptable evidence of age. The ID document must be current and include a photo of you and your date of birth. Here they are, pick one and put it in your wallet now!

Bag Checks are necessary, because some things are not allowed to be brought to Oktoberfest Brisbane. Examples of some things you can't bring in are glass, alcohol, weapons, illicit substances, pets, chandeliers or cement mixers. We do let you bring in things such as picnic blankets, tablecloths, seating cushions, children and your in-laws, but only if you promise to take them all home again at the end of the day.

Seriously though, it is a condition of entry to the festival that you permit a search of your possessions at the time of entry to the venue. Any item we may consider inappropriate can't be brought in and may be confiscated. Refusal to consent to a search will prevent your entry to the festival site which will probably cause tears.

Food and Drink on offer at Oktoberfest Brisbane is some of the most tasty and authentic available outside of Germany. It wasn't easy to find, so please support our handcrafted beverage and foodie partners by leaving yours at home.

Your Behaviour tells those around you a lot about you, so play nice! We're all there for the same reasons plus no one likes to be shouted at. Treat others how you want to be treated, otherwise we may ask you to leave the festival.

Alcohol is ok, but please follow our example and enjoy the selection of quality handcrafted beverages on offer at Oktoberfest Brisbane sensibly and responsibly. Be aware of your limits and make use of the many public transport options to get you home safely. We support the responsible service of alcoholic beverages.

The entire Oktoberfest Brisbane festival site is one licensed area where the Liquor Act 1992 applies. Only alcohol purchased from outlets at Oktoberfest Brisbane may be consumed on site. BYO alcohol is not permitted and will be confiscated. Any patron wishing to consume alcohol must have valid photo ID as defined in these terms & conditions. Supplying alcohol to a minor is an offence and you will be referred to police.

Unduly Intoxicated is not ok. We support our staff in the responsible service of alcoholic beverages and in the refusal of service if required. Our security staff are also trained in RSA. If you are unduly intoxicated, we cannot allow you to remain at the festival.

Smoking is not permitted in any area of the Oktoberfest Brisbane site except for in designated smoking areas. Alcohol is not permitted to be taken into designated smoking areas.

Illicit Drugs are not ok. If you are found supplying, consuming or in possession of illicit drugs while attending Oktoberfest Brisbane you will be referred to police.

Smart Wristbands are the latest craze and ours are so much more than just a fashion accessory! Your smart wristband is your unique key to your cashless experience at the Festival. As of 2017, it is the fast and exclusive way to make all your purchases at Oktoberfest Brisbane! You will also need it to get in and out of the Festival site. It is super simple and easy to use, head to the Cashless page on our website for the full rundown.

So how do I get mine I hear you say? It's easy: on entry, your ticket will be swapped for your personal smart wristband. You must wear it on your right wrist for the duration of your stay at the Festival. Anyone found on site without a valid wristband will be removed from site.

Damaged or defaced wristbands will not be accepted and wristbands which are removed or tampered with will be rendered invalid and will not be replaced. Replacement of lost, destroyed or stolen wristbands is entirely at the discretion of the festival organiser.

Clothing is ok! Please wear some. And trust us, you'll be sorry if you don't wear traditional German clothing (aka Tracht), because everyone else will be. Also, appropriate footwear is a must whilst on the Oktoberfest Brisbane site.

The Environment needs our love. 100% of the packaging you see at the festival is guaranteed recyclable or compostable. Show Mother Nature your love and place your litter in the correct bin at Oktoberfest Brisbane.

Glass is out. The Oktoberfest Brisbane site is a Glass Free Zone. To assist us in complying with the conditions of our Liquor Licence, glass, earthenware or things made from similar materials are not permitted to be brought into any part of the venue. But there's good news, check out our exclusive Oktoberfest Brisbane Stein! It looks like glass, but is 100% recyclable plastic. If you have yours from last time you came to the festival, you're welcome to bring it along.

Pets are awesome, but unfortunately not permitted on the Oktoberfest Brisbane site, unless they are registered assistance animals, in which case they are welcome.

Telling everyone about Oktoberfest Brisbane is ok! But please, if you are a professional or semi-professional photographer, videographer or journalist, you must make contact with our media team via [email protected] before you head to the festival to record it. Amateur cameras (such as for example mobile phones) are permitted but images may only be used for private purposes and not public display. At the discretion of the festival organiser, any amateur still and video footage is permitted to be shared on social media. By entering the festival site, you consent to being included in any still, video and/or sound recordings of the festival that may take place and waive all rights to any photograph, image or likeness produced whilst attending the festival and agree for these recordings to be used by the Festival Organiser at their reasonable discretion.

Ticketing

Purchasing tickets to Oktoberfest Brisbane can only be done online via our official Oktoberfest Brisbane ticketing provider Ticketbooth or at the gate on the day.

Online e-Tickets will be emailed, as a PDF attachment, to the email address you provided during the booking process once your credit card has been successfully charged. If you do not receive your e-ticket(s) please contact us by writing an email to [email protected]

Safeguard your e-Ticket like you would your cash, because it's essentially the same. If you lose it, anyone can use it.

Entry to the Festival is really easy. All you have to do is purchase a ticket and present valid photo ID (see these conditions for what is acceptable ID) along with your ticket for validation at the festival entry. e-Tickets can be presented either as a print out or on a smart device. Entry may be refused if tickets are damaged or defaced in any way, or if the festival organiser has reasonable grounds to believe the tickets have been acquired by unauthorised or illegal means. As festival organiser, we reserve the right to refuse entry to any patron but we will act reasonably in doing so.

Bayrisches Eck {Bavarian Corner} Full payment is taken at the time of booking. You will receive an email confirmation immediately after your payment is processed.

Bayrisches Eck {Bavarian Corner} Entry You will receive further details about entry into the Festival and the Bayrisches Eck {Bavarian Corner} closer to the Festival, to the contact details you provided during booking.

You and your guests can gain entry into the Festival site during normal Festival opening hours on the day of your booking. Entry into the Bayrisches Eck {Bavarian Corner} is available from the following times: Fridays from 5pm, Saturdays from 2pm and Sundays from 12 midday.

Bayrisches Eck {Bavarian Corner} Seating All tables seat 8 people maximum, no exceptions. For the provision of entry tickets, Oktoberfest Brisbane will be in contact with you closer to the Festival date to confirm the names of the 8 people who will be sitting at your table. Tables are sold on the condition that they are not resold or offered for resale or be used for advertising, promotions, competitions or other commercial purposes without Oktoberfest Brisbane's prior written authorisation. Any breach of these conditions and your table booking will be cancelled.

Refund Policy: Oktoberfest Brisbane is an all-weather Festival and there are no refunds on any table bookings, except as required by law. Refunds are purely at the discretion of Oktoberfest Brisbane and will be assessed on a case-by-case basis. If you made a mistake and accidentally bought a ticket for the same day as your pet hamster's birthday, give your ticket to a mate.

Cancellation or Postponement: In extraordinary circumstances, we reserve the right to cancel or postpone the festival and will act reasonably in doing so. We are a member of the Live Performance Association and subscribe to its Ticketing Code of Practice

Minors are family too so the festival is open to all ages. Patrons under the age of 18 years that attend the festival receive free entry but in accordance with the Qld Liquor Act 1992 must be accompanied and supervised by a responsible adult at all times. Each of the following persons is a responsible adult in relation to a minor: (a) A parent, step-parent or guardian of the minor, or (b) an adult who has parental rights and responsibilities for the minor.

Conditions of Sale in addition to the above do apply, so take a moment to read them here: Tickets are sold or provided (including any resale or subsequent assignment) on the express condition that the holder is bound by these and all other terms & conditions issued by the festival organiser, Oktoberfest Brisbane Pty Ltd (ACN 624 012 415). By presenting a ticket for validation, you agree to be bound by the full terms and conditions contained herein, as available on the Oktoberfest Brisbane website. We reserve the right to amend these terms and conditions from time to time without notice.

All tickets and products are priced in Australian dollars and prices are shown inclusive of GST as it may apply. We reserve the right to charge reasonable ticket booking fees and/or credit card surcharges to cover administrative costs. We will make you aware of any such charges before completing your transaction.

Unless prior written consent is provided by Oktoberfest Brisbane Pty Ltd, tickets may not be offered for unauthorised re-sale on any 3rd party websites (for example eBay or Gumtree). Tickets may not be resold or offered for resale at a premium or used for advertising, promotion or other commercial purposes (including but not limited to competitions and trade promotions) or to enhance the demand for other goods or services, either by the original purchaser or any subsequent bearer. Tickets cannot be used as part of any marketing, media or sales promotion whether commercial or non-commercial. If a ticket is used in breach of these conditions, it may be cancelled without refund and the bearer of the ticket may be refused admission.

Privacy is as important to us as it is to you. We value your trust and will never sell, share or rent your personal information to unsolicited third parties. In order to deliver services associated with the festival, we may need to collect and/or store personal information about you such as your name, address, credit card or payment details and telephone number. We may also need to disclose your personal information as required by law or as permitted under the Privacy Act 1988 (Cth). Our Privacy Policy outlines how we handle your personal information in more detail.

You and Your Property are your responsibility. You acknowledge that neither Oktoberfest Brisbane nor the Brisbane Showgrounds will be responsible for any loss or damage to property (including personal property such as bags, money or other personal items) brought to or purchased at the festival by you. You will be liable for any loss or damage caused at the festival by you. Entry to the festival site is at the ticket holders own risk. In the event of injury or illness we may, at your cost, arrange medical treatment and/or emergency evacuation as deemed essential for your safety.

Donations: Contact information on all charity donations will be passed to Orange Sky Australia for tax purposes.

Release: To the fullest extent permitted by law, we do not accept liability of any nature for the acts, omissions or default of those providing services in connection with the festival or any liability for any injury, damage, loss, delay or additional expenses which are incurred at or in association with this festival. Where legislation implies any condition or warranty which cannot be excluded or modified, that condition or warranty will be deemed to be included in this agreement. However, our liability for any breach of such condition or warranty will be limited, at our option, to the resupply of the services or the cost of having the services supplied again. In no event will we be liable for any indirect, consequential, exemplary or special damages.

Jurisdiction: This agreement is governed by the laws of Queensland, Australia.
